SHARE is an intervenor in a major securities class action case before the Supreme Court of Canada. CIBC v Green, which was heard by the Court on February 9, 2015, concerns the ability of investors to sue companies which provide incomplete or inaccurate disclosure about the state of their business.
SHARE, represented by Groia and Company, is arguing that the ability of investors to seek a remedy for public company misrepresentations is critical to healthy and transparent capital markets.
As an intervenor, SHARE has no direct interest in the case but provides the Court with the perspective of institutional investors, which play an important role in Canadian capital markets and have an interest in ensuring high standards of disclosure and transparency in issuer-investor relationships. SHARE also appeared as an intervenor in the same case before the Ontario Court of Appeal.
